Abstract

Fundamental concepts of Swiss Law:Contract Law (freedom of contract, when a contract becomes binding, what constitutes breach of contract, the remedies available for breach of contract) and Torts Law (concepts of negligence and strict liability).Constitutional and administrative law (organization and duties of the state, sources of law, fundamental rights, procedure of public authorities).

Objective

Introduction to Swiss constitutional and administrative law as well as the law of contracts and torts serving as a basis for advanced legal courses.

Content

1st Part: Introduction to the Law of Contracts and Torts Contracts; formation, interpretation and amendment of contracts; error and misrepresentation; extent of and limits to contractual freedom; contractual forms, agents, and breach of contract; torts; breach of a duty and strict liability. Corporation law: purpose of the incorporation of a company, corporate gouvernance. 2nd Part: Introduction to Swiss Constitutional and Administrative Law Constitutional Law: functions and sources of law. Structure and organization of the state. Federal authorities. Principles and legal foundations of the state's activities. Individual rights and liberties. Equality before the law. Administrative Law: relation between administrative bodies and citizens. Administrative decree. Enforcement of administrative law. Particular branches of administrative law. Administrative organization and procedure. International legal community.
